Co-Regulation Agreement on the Procedure and Rules for the Terms of Trade of Works by Independent Producers
Pursuant to Article 10 and Article 69, paragraph 1, sub-paragraph 18 of the Electronic Media Act, the Electronic Media Council adopted at its session held on 20 November 2017, the Co-Regulation Agreement on the Procedure and Rules for the Terms of Trade of Works by Independent Producers concluded between Croatian Radiotelevision (HRT), the Croatian Association of Independent Producers (HDNP) and the Agency for Electronic Media (AEM). The negotiation process was carried out under the principles agreed in the founders' co-regulation agreement of 17 February 2017. HRT and HDNP, which also represented the Croatian Producers Association (HRUP) and the Croatian Film Directors' Guild, negotiated on the conditions and rules for the procurement of works by independent authors. Under the founders' agreement, the AEM participated in the process as a moderator, a coordinator, and a monitoring body pointing out at legal obligations, ensuring available documents, research and insight into the best European practice, as well as intermediating as required by offering solutions at times when the participants could not have come to a mutual understanding. The creation process of this Agreement was governed by the Croatian law, the AVMS Directive, and the best European and Croatian practice.
While signing the Agreement, the Electronic Media Council proposed to the Croatian Radiotelevision and the Croatian Association of Independent Producers the organization of the public presentation of said Agreement to all interested stakeholders.
